    I am over 3 weeks pregnant, I want a abortion.

    I have 2 little baby's, the youngest is 4mths, I am NOT ready for another baby.

    Is it haram to have a abortion? I read into it a little, apparently the soul does not enter the baby until around 4 mths..can I have a abortion.

    pls help.

    Rulings to do with abortion
    I would like to know the rulings that have to do with abortion of the foetus at various stages.

    Praise be to Allaah.

    Firstly:

    We have already stated in the answer to question no. 42321 the ruling on abortion. Please refer to this information.

    Secondly:

    With regard to the rulings following an abortion, they vary according to the time of the abortion, and fall into four categories, as follows:

    1 – If the pregnancy is aborted within the first two stages (the nutfah (drop) stage which results from the mixing of the “two waters” which is the first forty days after the embryo attaches itself in the womb, and the ‘alaqah (clot) stage where it turns into solid blood during the second forty days), which add up to a total of eighty days, then in this case if it is aborted as a nutfah or ‘alaqah, there are no rulings to be followed, and there is no scholarly dispute on this point. The woman should continue to fast and pray as if she had not had an abortion, but she has to do wudoo’ for each prayer if she has any bleeding, as in the case of a woman suffering from istihaadah (non-menstrual vaginal bleeding).

    2 – If the pregnancy is aborted in the third stage, the mudghah (chewed piece of flesh) stage, when the embryo looks like a piece of meat with the limbs and features beginning to appear, which lasts for forty days from the eighty-first to the one hundred and twentieth day, then there are two scenarios:

    (i) This embryo does not have any human features and the midwives or other attendants did not testify that this was the beginning of a human being. In this case the ruling on abortion of this mudghah is the same as the ruling on abortion in the first two stages, and there are no rulings to be followed.

    (ii) The embryo has complete human features or some human features such as a hand or foot, etc, or there are features but they are indistinct, or the midwives or other attendants testified that this was the beginning of a human being. In this case the rulings on nifaas are to be followed, and this signals the end of ‘iddah (waiting period following divorce or death of the husband, if applicable).

    3 – If the pregnancy is aborted in the fourth stage, i.e., after the soul has been breathed into the foetus, which is after the beginning of the fifth month or after one hundred and twenty days of pregnancy have passed. Here there are two scenarios:

    (i) If the foetus did not cry after birth, then the rulings mentioned with regard to the second stage of the mudghah are to be followed, but in addition the foetus should be washed, shrouded and the funeral prayer offered for him; he should be given a name and the ‘aqeeqah offered for him.

    (ii) If the foetus cried after birth, then the rulings concerning a full-term baby apply, as mentioned above; in addition the child may take possession of wealth bequeathed or inherited; he may inherit or be inherited from, etc.

      Ruling on aborting a pregnancy in the early stages
      What is the ruling on aborting a pregnancy in the early months (1-3) before the soul is breathed into the foetus?.

      Praise be to Allaah.

      The Council of Senior Scholars issued the following statement:

      1 – It is not permissible to abort a pregnancy at any stage unless there is a legitimate reason, and within very precise limits.

      2 – If the pregnancy is in the first stage, which is a period of forty days, and aborting it serves a legitimate purpose or will ward off harm, then it is permissible to abort it. But aborting it at this stage for fear of the difficulty of raising children or of being unable to bear the costs of maintaining and educating them, or for fear for their future or because the couple feel that they have enough children – this is not permissible.

      3 – It is not permissible to abort a pregnancy when it is an ‘alaqah (clot) or mudghah (chewed lump of flesh) (which are the second and third periods of forty days each) until a trustworthy medical committee has decided that continuing the pregnancy poses a threat to the mother’s wellbeing, in that there is the fear that she will die if the pregnancy continues. It is permissible to abort it once all means of warding off that danger have been exhausted.

      4 – After the third stage, and after four months have passed, it is not permissible to abort the pregnancy unless a group of trustworthy medical specialists decide that keeping the foetus in his mother’s womb will cause her death, and that should only be done after all means of keeping the foetus alive have been exhausted. A concession is made allowing abortion in this case so as to ward off the greater of two evils and to serve the greater of two interests.

          In the name of Allah, Most Compassionate, Most Merciful,

          Abortion and the termination of pregnancy is the expulsion of a foetus from the womb of a woman. This may either be by consuming of certain drugs or by emptying the womb through the process of suction.

          Life is sacred:

          Islam regards human life sacred. Allah Most High says:

          “And verily we have honoured the children of Adam” (Surah al-Isra, V.70).

          It does not matter where the life exists. Whether the life is extra-uterine or intra-uterine, its location has no significance on its sanctity. This sanctity applies not only to human life, but to the human body as well. Hence, according to Shari’ah, the physical body of a human after death is just as sacred as it was before death. The degree of sanctity of life is greater than that of the body. This is one of the reasons why it is unlawful (Haram) to consume the meat of a human, dead or alive.

          The Shari’ah ruling on abortion:

          Abortion can be divided into two stages:

          a) Abortion after the soul (Ruh) enters the foetus

          b) Abortion prior to the entry of the soul in to the foetus

          Before mentioning the ruling on abortion with regards to these two stages, it must be remembered here, that according to Shari’ah the soul (Ruh) enters the foetus at 120 days (4 months) from conception.

          The Jurists (Fuqaha) have based this duration upon a Qur’anic verse and a statement of the beloved of Allah (Allah bless him & give him peace). In the verse Allah states the stages of development of the embryo in the womb of the mother. Allah Almighty says:

          “And verily we did create man from a quintessence (of clay). Then we placed him (as a drop of sperm) in a place of rest, firmly fixed. Then we made the sperm into a clot of congealed blood. Then of that clot we made a (foetus) lump. Then we made out of that lump bones and clothed the bones with flesh. Then we developed out of it another creature (by breathing life into it). So blessed be Allah, the most marvellous creator” (Surah al-Mu’minun, 12/13/14).

          In the Hadith recorded by the two most authentic authorities, Imam al-Bukhari and Imam Muslim in their respective Sahih collections, the Messenger of Allah (Allah bless him & give him peace) discussed in detail the periods elapsing between these stages, mentioned by the Qur’an.

          Abdullah ibn Mas’ud (Allah be pleased with him) narrates that the Messenger of Allah (Allah bless him & give him peace) said:

          “The seed of one of you remains in the womb of the mother for forty days in the form of a Nutfa (sperm). Then it remains like a clot for another forty days, and then for a same number of days like a lump of flesh (when the formation of the limbs and the growth of the bones begin) (Sahih al-Bukhari & Sahih Muslim).

          The great Hanafi Faqeeh Ibn Abidin States in his Radd al-Muhtar:

          “The soul enters the foutus at one hundred & twenty days (4 months), as established by the Hadith” (Radd al-Muhtar, 1/202)

          The ruling on abortion in stage (a) i.e. after the entry of the soul into the foetus which is (as explained) 120 days, is that, it is totally impermissible and tantamount to murder, as it results in the taking out of an innocent life. All the scholars have unanimously condemned such a ghastly act.

          Imam Ibn Tamiiyah states in his Fatawa collection:

          “Aborting a foetus has been declared unlawful (Haram) with the consensus of all the Muslim scholars. It is similar to burying an infant alive as referred to by Allah Almighty in the verse of the Qur’an: “And when the female infant, buried alive, will be asked as to what crime she was killed for” (Surah al-Takwir, 8) (Fatawa Ibn Tamiyya, 4/217).

          Ibn Abidin (Allah have Mercy on him) also states the prohibition of this gruesome act in his treatise ‘Radd al-Muhtar’:

          “If a woman intends to abort her pregnancy, then the Fuqaha have said: If the period of the soul being blown into the foetus has elapsed, it will be impermissible” (Radd al-Muhtar, 5/276).

          However, some Fuqaha and contemporary scholars have given a dispensation to abort the pregnancy after 120 days, in the situation where the life of the mother is in certain and absolute danger. This is based on the Juristic principle stated in the books of Usul al-Fiqh:

          “If one is overtaken by two evils, one should choose the lesser of the two” (al-Ashbah wa al-Naza’ir, P.98)

          They state that the mother’s life should be saved and the foetus aborted, as the mother is established in life, with duties and responsibilities, whereas the unborn child is still in the mother’s womb. But it should be remembered that the mother’s life must be in certain danger, and that this should be advised by a qualified and experienced Muslim doctor.

          With regards to stage (b) i.e. prior to the entry of the soul into the foetus (120 days), the ruling is that, even in this case it is unlawful (Haram) to abort the pregnancy.

          The reason why abortion prior to the soul entering the body will not be permitted is that, although there may not be life in the foetus, but the foetus is considered to be part and parcel of the mother’s body as long as it remains in the womb. Thus, just as one’s very own life and also all the limbs and organs of the human body are trust given by the Almighty Creator, so too is the foetus also a trust given to the mother by Allah, and she will not have a right to abort it.

          The only difference here is that the sin of aborting the foetus will be of a lesser degree then aborting it after 120 days. It would not be regarded as murder, rather violating the rights of a human organ entrusted to the mother by Allah Almighty.

          It is stated in Radd al-Muhtar:

          “It is not permissible to abort the pregnancy before and after the entry of the soul into the foetus” (Radd al-Muhtar, 5/279).

          However, in certain extreme circumstances, it would be permitted to abort the pregnancy, before the entry of the soul (120 days), such as: when the woman conceives after being raped, the mothers life or health is in danger, or repeated pregnancies severely damages her health, etc…

          Imam al-Haskafi writes in Durr al-Mukhtar:

          “Aborting the pregnancy will be permissible due to a valid reason, provided the soul has not yet entered the foetus”.

          It should be remarked here that pregnancy due to unlawful and illegal sex is no reason and excuse for abortion. The embryonic life farm in the mother’s womb is honoured and sacred even though it is a result of adultery (Hidaya, 2/292).

          In conclusion, abortion after 120 days is totally unlawful and tantamount to murder. Some Fuqaha, however, have given a dispensation only in the situation where the mothers life is in certain danger. As far as abortion before the 120 days have elapsed is concerned, it will still be unlawful, though the sin will be of a lesser degree, and it will become permissible if there is a genuine and valid reason.

                Oh gosh..No please don't do that..I know it may seem daunting but you've just got to go with it.InshaAllah just make use of the 9months preparation time that you have and just do your best..I know it will be difficult with a very young child already in tow,but you and your husband need to work together inshaAllah in order to try and ease this pregnancy.Think about all the people who are desperate to have children but cannot due to various reasons..Allah 'azza wa jal has blessed you with another child subhanAllah,cherish what may be taken for granted..

                  abortion is haraam...and is also a crime in Allah's eyes.

Now imagine about the child in your womb....Allah created this child too just like you and me.....imagine how Allah would feel......you would be responsible....you would be killing Allah's creation....how angry will He be? can you imagine?

                      We always say "consult a scholar" but this isn't easy, I don't know of any in my area that I could speak to if I needed help. Maybe some contact info might help the sister out if someone has any?

                        So why have sex then?

                        It's haram full stop. Were you raped? Is your life in danger? If It's a no for both questions. Then yes, its haram to have an abortion.

                        Think about itn the future. In a few years time, tell that to your kids. See the reaction on their face when they find out that their mother killed they're brother/sister because she wasn't "ready".

                            Sis, my mom had me and two of my siblings very close together (my older one is only not even a year older than me and my other one is a year and 2.5 weeks younger). If you keep having faith in Allah, He will provide for you. But if you abort your child and then find that in a few months time you're able to take care of him/her, you'll regret it. You have a husband and family, if you feel like you're overworked with the kids ask for help inshallah.

                              salam sis i know it must be really hard and you must feel really scared but like everyone has said that children are gifts from allah. By the time you will have this baby your other children will have gone bigger the 4 month old will inshallah be crawling and be eating solids so it will be a little easier. i dont know if your oldest child has started school or nursery but if they havent send your oldest to a creche if theres one near you even if its for a couple of hours a day it will help. if your parents or your husbands parents are near send your oldest child there for the day let them help you. My own sister went through what your going through and with Allahs help she got through it and she hardly got any help from family and now mashallah her youngest isl nearly 4. REMEMBER ALLAH NEVER BURDENS A SOUL WITH MORE THEN THEY CAN BEAR. So my sis put your trust in Allah he is the one who has willed for this to happen and he is the one who will help you
