  • Urfi Marriage and Mut'ah Marriage

Assallam alleykum brothers and sisters. This two types of marriages are common among many muslims. why is the mut'ah type haram and the Urfi ( a kind of marriages in which the Ninkah is not publicly announced or registerd officially) halal? despite the similarities

Re: Urfi Marriage and Mut'ah Marriage

Neither is halal as commonly practiced. The Prophet (pbuh) specifically forbade mut'ah marriage, though the Shi'a don't recognize that hadith, which is their justification for practicing it. As far as I know, Sunnis scholars unanimously disallow it.

Keeping a marriage a secret is haram. Urfi marriages as practiced in Egypt and some other countries are usually done without the knowledge of the woman's wali, and often without the required two witnesses. It's rare to find one that's actually valid.

If an urfi marriage meets the Islamic requirements, then it comes down to the intent: a marriage entered with the specific intent of divorcing is haram and invalid. No human can read minds and know for sure that someone getting married doesn't intend that, but since it's haram, it can't be written into the contract as is done in mut'ah marriage.
