I know they have to make up the ones they have missed, but someone tells me they can give money to charity instead of fasting!

Is this true?

I ask this because some family is in this situation...

Allahu alam I dont think they will be able to do that. Feeding the poor and such is done as an option if people are continually ill and they can not fast. Mainly I have heard it in reference to when people have broken their fast someway which makes it necessary for them to do kaffarah (60 days fast) and they are ill so they could not do that, then they must feed poor people for sixty days instead of that. Or people who are permanantly ill and can not do Ramadan may feed the poor instead, but if someone is well and able to fast and they just miss this few days of fasting, there does not seem to be anything preventing them from just making up the fasts as is the normal way? It's not a hardship to make these fasts up, it could only be maximum ten days...

you need to make up the fast within the year before the next ramadhan approaches.. if you miss it then you have to pay.. i think feed one miskeen person a full meal for 30 days...
but better to make up the fast

Salaam to all my dear brothers and sisters.

As is known woman have to make up for the missed fasts during this blessed month. The fasts should be made up fairly quickly after the month has ended. Unless this person is now ill she can not just feed the poor.

But the other thing here is that you may have to see someone more knowledgeable and tell them the facts as to why or what is happening with this person.

If this person is in a situation different from making up the fasts for the missed ones during her period then they should see someone about them. But if they just want to sort of pay off by feeding the poor then this in not correct.

Question:
I did not fast some days in Ramadaan because of my period. This happened a few years ago, and I have not fasted these days until now. What do I have to do?.

Answer:
Praise be to Allaah.

The imams are agreed that whoever does not fast some days of Ramadaan has to make up those days before the next Ramadaan comes.
They quoted as evidence for that the hadeeth narrated by al-Bukhaari (1950) and Muslim (1146) from ‘Aa’ishah (may Allaah be pleased with her) who said: “I used to have fasts that I still owed from Ramadaan, and I could not make them up until Sha’baan, and that was because of the position of the Messenger of Allaah (peace and blessings of Allaah be upon him) [as a husband].”
Al-Haafiz said:
It may be understood from her keenness to fast them in Sha’baan that it is not permissible to delay making up fasts until the next Ramadaan begins.
If a person delays making up fasts until Ramadaan begins, one of the following two scenarios must apply.
1 – The delay is for a reason, such as being sick and the sickness lasting until the following Ramadaan begins. There is no sin on a person for delaying in this case, because he has an excuse, and he only has to make up the days missed. So he should make up the number of days that he did not fast.
2 – There is no reason for the delay, such as when a person was able to make up the fasts but he did not do so before the following Ramadaan began.
This person is sinning by failing to make up the fasts with no excuse. The imams are agreed that he must make up the fasts, but they differed as to whether along with making up the fasts he must also feed one poor person for each day or not.
Maalik, al-Shaafa’i and Ahmad said that he must feed a poor person, and they quoted as evidence for that the reports narrated from some of the Sahaabah such as Abu Hurayrah and Ibn ‘Abbaas (may Allaah be pleased with them).
Imam Abu Haneefah (may Allaah have mercy on him) was of the view that he does not have to feed a poor person as well as making up the fasts.
He quoted as evidence the fact that Allaah commands the one who does not fast in Ramadaan only to make up the missed fasts, and He did not mention feeding a poor person. Allaah says (interpretation of the meaning):
“and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]

This second view was also favoured by Imam al-Bukhaari (may Allaah have mercy on him). He said in his Saheeh:
Ibraaheem (i.e., al-Nakha’i) said: If a person neglects (to make up missed fasts) until the next Ramadaan comes, he should fast the missed days of both months. But he did not think that he has to feed a poor person. There was also a mursal report from Abu Hurayrah and Ibn ‘Abbaas which says that he should also feed a poor person. Then al-Bukhaari said: But Allaah does not mention feeding a poor person, rather He says (interpretation of the meaning):
“…the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said, when noting that it is not obligatory to feed a poor person:
With regard to the words of the Sahaabah, their use as evidence is subject to further discussion if it goes against the apparent meaning of the Qur’aan. In this case, saying that it is obligatory to feed a poor person goes against the apparent meaning of the Qur’aan, because Allaah only enjoined making up the same number from other days, and He did not mention more than that. Based on this, we should not oblige the slaves of Allaah to do any more than they need to fulfil their duty. But what was narrated from Ibn ‘Abbaas and Abu Hurayrah may be interpreted as referring to what is mustahabb, not what is obligatory. The correct view with regard to this issue is that a person does not have to do anything more than making up the missed fasts, but he is sinning if he delays doing so.

Based on this, then what is obligatory is to make up the fasts only, but if a person wants to be on the safe side and feed one poor person for each day missed, then that is good.
The woman who asked this question – if she delayed making up the fasts with no excuse, has to repent to Allaah and resolve not to repeat this mistake in the future.

She could not find a poor person to feed instead of fasting in Ramadaan – should she give the money in charity?

I am a sick woman suffering from a chronic illness. My doctor advised me not to fast and I cannot find any poor person to feed. How much money may I give instead?.

Answer:
Praise be to Allaah.

We ask Allaah to bless you with healing and to make this sickness an expiation for your sins and to raise you in status in the Hereafter.

The person who is chronically sick and unable to fast or make up the missed fasts is not obliged to fast, but he must feed one poor person for each day, because Allaah says (interpretation of the meaning):

“And as for those who can fast with difficulty, (e.g. an old man), they have (a choice either to fast or) to feed a Miskeen (poor person) (for every day).”

[al-Baqarah 2:184]

‘Abd-Allaah ibn ‘Abbaas (may Allaah be pleased with him) said: This has not been abrogated. It refers to an old man or an old woman who are unable to fast; they should feed one poor person for each day. Narrated by al-Bukhaari, 4505.

The sick person for whom there is no hope of recovery comes under the same ruling as an old man.

Ibn Qudaamah (may Allaah have mercy on him) said:

The sick person who has no hope of recovery may break the fast, and he should feed one poor person for each day, because he is like an old man. End quote.

The Muslim lands are full of poor and needy people who cannot find enough to feed them and their families. There is no state that is without its poor, even if they are hard to find in some countries. No country is without its charitable committees who take on the task of making sure that zakaah and charity reach those who are entitled to them.

Even if you cannot find a poor person to give food to, what are you going to do with the money that is equal to the value of the food? To whom will you give this money? This means that the problem is still there. It is not permissible to give this money – even if it were permissible to give it in the form of money – to anyone but the poor and needy who are entitled to it.

Whatever the case, you must try hard to look for poor and needy people in your country. Even if you do not know them, you can delegate someone whose religious commitment you trust to give this food to someone who is entitled to it. It makes no difference whether it is an individual or a charitable organization.

Remember that it is not permissible for you to give money – no matter how much – instead of giving the fidyah that has been enjoined upon you, because Allaah has enjoined upon you “to feed a Miskeen (poor person)”, and He has not enjoined you to give money. Allaah says (interpretation of the meaning):

“And as for those who can fast with difficulty, (e.g. an old man), they have (a choice either to fast or) to feed a Miskeen (poor person) (for every day).”

[al-Baqarah 2:184]
