Allah (swt) says:
إِنَّ اللّهَ يَأْمُرُكُمْ أَن تُؤدُّواْ الأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُم بَيْنَ النَّاسِ أَن تَحْكُمُواْ بِالْعَدْلِ ...
“Verily Allah commanded you that you should return the trust to who it belongs to, and when you judge between the people, judge by Adl …” [EMQ 4: 58]
This ayah obliges us to give the huqooq(rights) to whom they belong. Allah (swt) ordered us to judge by ‘Adl, if you do not judge by Adlyou will judge by oppression. And ibn Abbas said that “Al ‘Adl is Al Shari’.” This means that if you do not rule by Shari’ah, you will rule by oppression, this is why Allah (swt) said:
وَمَن لَّمْ يَحْكُم بِمَا أنزَلَ اللّهُ فَأُوْلَـئِكَ هُمُ الظَّالِمُونَ
“Whoever rules by other than what Allah revealed is Al Zalimun.” [EMQ 5: 45]
Allah (swt) says:
يَا أَيُّهَا الَّذِينَ آمَنُواْ أَطِيعُواْ اللّهَ وَأَطِيعُواْ الرَّسُولَ وَأُوْلِي الأَمْرِ مِنكُمْ ...
“O you who believe, Obey Allah and Obey the Messenger, and those in authority from among you.” [EMQ 4: 59]
Allah has made Takhseesto this obedience, it is specific to Allah, and Allah (swt) revealed directly through Jibreel to Muhammad (saw), so Allah has made Takhseesto Allah, and he has made Takhsees, (specifically) to obey the Messenger Muhammad (saw), meaning that you must obey none but Allah and His messenger.
And furthermore, after that, He (swt) said:
وَأُوْلِي الأَمْرِ مِنكُمْ ...
“… And those in authority from among you.” He (swt) did not say “Obey those in authority,” meaning that there is no obedience to them unless they obey Allah (swt) and His Messenger.
Obeying Allah and the Messenger of Allah means to obey the wahie(revelation), However ulil amr (those in authority) are not connected to the wahie, unless they implement it.
Allah (swt) said “and ulil amri minkum”, they can be of two types:
1- LEGITIMATE
i. Rulers - This can be the Khalifah, and all of his deputies, including: his assistants, judges, governors, amir of Jihad, Government administration etc
ii. Scholars - These are either people who are Mujtahid or the people who are Mujahid. This is why Imam Ahmad and Abdullah ibn Mubarak declared that if there is any conflict in relation to Jihad, you only ask the Mujahid about it.
The scholar if he Obeys Allah, has authority over you. The Hadith says:
“There is no obedience to any creation if he disobeys Allah (swt).”
2- ILLEGITIMATE
i. Illegitimate ruler - They are either Kafir asslie or Kafir murtad.
ii. Illegitimate scholar - They are either Kafir asslie or Murtad – e.g. Qardawi, Badawi, Mufti of Morrocco, Mufti of Saudi Arabia, etc. the Mufti of any Taghout, is himself Kafir taghout.
The one who follows the taghout is Taghout, so anyone who upholds any man-made law is taghout, whether he is in the military or a civilian
If anybody else orders you to do anything, you do not obey him unless he is in authority, if he asks you something Halal, you do it because Allah permitted it, and if he asks you to do something Allah has forbidden, you must not obey him.
Furthermore, there is no way to have two caliphs, there is only ever one Khalifah, the Hadith says: “if two caliphs rise, kill the latter one.”
There is text to say that if someone becomes a ruler, you can raise the sword against him, and his assistants if they uphold a kufr system, they take the same Hukm as eachother.
The hadith says,
“Obey them as long as they obey Allah, obey them until you see the kufr bouah, then rise the sword.”
So the obedience is only while he is Muslim, but when he is apostate, we are obliged to remove him by the sword, according to our capability, we should kill them if we can or we should call others to do so, or facilitate to do so, or speak out against them, or leave if you cannot, and Allah (swt) will bring about the change.
The ayah says “from among you”, i.e. from the Muslims. The ayah continues:
يَا أَيُّهَا الَّذِينَ آمَنُواْ أَطِيعُواْ اللّهَ وَأَطِيعُواْ الرَّسُولَ وَأُوْلِي الأَمْرِ مِنكُمْ فَإِن تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللّهِ وَالرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِاللّهِ وَالْيَوْمِ الآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلاً
“If you dispute in any matter, attribute back to Allah and his Messenger.” [EMQ 4: 59]
So if you dispute with those legitimate leaders in any matter, you must go back to refer to Allah and His Messenger. So it is impossible to be that the ayah to be referring to the illegitimate leaders, because in all matters you must refer back to Allah and His Messenger.
Allah (swt) said:
“If Muhammad dared to say something I never told him, I will take him by one hand, and cut his aorta with my other hand, and will show him no mercy.”
So Allah is the only commander, not even Muhammad (saw) can command, but is the one that conveys the commands of Allah (swt), and the Sahabah are the ones that understand the commands. Their understanding of the Qur'an and Sunnah is binding on us.
Allah (swt) says:
أَلَمْ تَرَ إِلَى الَّذِينَ يَزْعُمُونَ أَنَّهُمْ آمَنُواْ بِمَا أُنزِلَ إِلَيْكَ وَمَا أُنزِلَ مِن قَبْلِكَ يُرِيدُونَ أَن يَتَحَاكَمُواْ إِلَى الطَّاغُوتِ وَقَدْ أُمِرُواْ أَن يَكْفُرُواْ بِهِ وَيُرِيدُ الشَّيْطَانُ أَن يُضِلَّهُمْ ضَلاَلاً بَعِيدًا
“Have you seen those who claim to believe in what has been revealed to you and revealed before you, and yet they wish to go for judgement to the taghout while they have been ordered to reject it, but shaytan has led them far astray.” [4: 60]
So it cannot be that we can refer to the taghout rulers, the illegitimate rulers. We cannot obey the kafirs, that it impossible for Allah (swt) says:
يَا أَيُّهَا النَّبِيُّ اتَّقِ اللَّهَ وَلَا تُطِعِ الْكَافِرِينَ وَالْمُنَافِقِينَ إِنَّ اللَّهَ كَانَ عَلِيمًا حَكِيمًا
“O Prophet (i.e. O Muslims that believe in the Prophet), fear Allah, do not obey the Kafir nor the Munafiq…” [33: 1]
Allah (swt), if he addresses the prophet is addressing the Ummah that he has been sent to. Allah (swt) said: “Fear Allah (i.e. have Taqwa) …”, Ibn Abbas said:
“Taqwa, is like if you walk in a road, and either side is thorns, you walk in a way not to be hurt, to stick to the straight path.”
I.e. to stand firm to the deen, Allah (swt) says:
وَمَا كَانَ لِمُؤْمِنٍ وَلَا مُؤْمِنَةٍ إِذَا قَضَى اللَّهُ وَرَسُولُهُ أَمْرًا أَن يَكُونَ لَهُمُ الْخِيَرَةُ مِنْ أَمْرِهِمْ وَمَن يَعْصِ اللَّهَ وَرَسُولَهُ فَقَدْ ضَلَّ ضَلَالًا مُّبِينًا
“It is not allowed for a believing man or a believing woman, when Allah and his messenger has ordered a matter, to have any choice (or option) but to follow their command. And whoever disobeys Allah and his messenger, has gone completely astray.” [33: 36]
