This goes specificly to the brother who owns the site, i just wish to make somments and criticisms, inshaAllah.

Ma'sha Allah you have a very well-designed site with JAVA technology, but there are some things which i am curious about, please answer me if you can. best if you answer on this forum because other brothers/sisters may benefit from them:

1) Have you got permission from the artists themselves to upload the tracks, i know you are trying to implement the deen specially to young muslim brother and sisters, ,but you will need to provide valid proof of permission being granted to you. At the end of the day, you are halting and jeupardising your own brothers business and a source of income. And Allah(swt) will hold you accountable also, because this is a form of stealing and you are lessening the chance for our Ummah to advance.

2) You are using free web servers to allow your downloads, if Meem Music, Awakeing and others find out, they wil take direct action, firstly, towards 250mb.com, then the rest,

Brother, let me give you a massive word of advice, please, first get the permission and then attempt to stream the files, because there are various methods used nowadays to track people, and i wouldn't want you to get in any sort of mess, you should be striving to give Daw'ah in a pure manner, not taking Copyrights lightly, i know its a Man-made law, but it has to be implemented, and in Islam, you have to ask permission to the owner in order to take his/her possession.

Do take great concideration of this, i make Du'a that Allah(swt) strengthens your Imaan and keep you in good health, ameen.

Jazak Allah Khair for the Fatwaa which you have managed to scrutinize from islamonline.net, this should be even a more powerful hint to brother Ehtesham, that he takes great notice of this, i know he is looking at these new views on his site, and i also know as a fact, he is trying to stay anonymous, but my advice to the brother is to say, that there are more beautiful nasheeds out there which don't have any copyrights on them, and he should be able to store them in the freely provided servers, for viewers to download.

Brother Ehtesham, if you fear Allah(swt) and love the Prophet Muhammad (PBUH) you will most definately take those nasheeds off and replace them with nasheeds that are free to distribute, inshaAllah.

I can give you a list of artists who don't use Copyrights in their nasheeds, and are doing the work as fee sabeelillah, i will be able to help you out if you are interested, inshaAllah

Brother, i am aware of what you are doing, and i am also aware of who is taking actions against your sites and domains, and host providers. I am also aware of the fact that big businesses like: Meem and Awakening are taking actions against your site, and i will 100% support them in doing that, because when you give Da'wah, you don't give it by stealing their materials.

Now, when you upload FULL LENGTH nasheeds off these albums, the artists such as Sami Yusuf, Inayet Petker and the rest lose out, because this is their livelihood, and they live on producing nasheeds through their record label.

If you still don't understand the matter, brother my advice to you is that you repent to Allah(swt), and i will also advise you not to boast about you got 1,000 visitors to your site in a month, because there are other sites, which are bigger than yours and they get over 50,000 hits per month.

So, when you let people download non-copyrighted nasheeds, you are doing this in a Halal manner, however, at the same time, you will be anabling our Ummah to Advance further.

Please take into consideration

Your stubborness is a joke. Not being interested or saying that you are misguided is not an excuse to keep up your website with full copyrighted nasheed downloads.
You must realise the hard work that goes into making nasheeds, it is not something that can be done overnight.
If you cannot take the songs down for your own reasons, at least take them down for the respect of the artists and producers.
If anyone would put up the full nasheeds of the album I'm producing for Kamal Uddin then I wouldn't hesitate to go to their house and take their PC away.

Just to let you know, it's bro Masum, not sis Masumah :)

The intention no doubt needs to be to please Allah, but just because they're making money doesn't mean that it's not their intention to please Allah.
People need to live and you can't live without having any money. A lot of the artists do Nasheeds for a living, without any other jobs.
The reason to have sites like Ehtesham's taken down is for the bigger picture so that people still buy original CDs so the artist's and companies can make a revenue.
Freely available files mean people downloading them, coyping them to CD and then a friend of theirs asks them for a copy and it gets passed on like that. This eventually cuts down the probability of people buying original CDs.

I think most of you loat are arguing about copy rights. I dont know if there has been a stronger opinion about this law by Islamic Scholars and is still in its infancy.

For me i would like to know a few things:

1) If i buy a CD and of my friend visits me and listens to it will that not be a violation of copy rights ? If not then why ?
Why wont it be that my friend who is listening to it is 'wrongfully eating away someones property'.

You may want to argue about the loss of revenue to the producers. Well in that case.

2) If i buy a pizza and share it with another brother can i say that had i not shared the pizza with the brother, he would have purchased a pizza for his own consumption. So in that case my sharing of the pizza is a loss of revenue to the producer of the pizza.

3) When the person (singer) sells his voice on a cd and i buy it. Now the voice on the cd is my property and i should be free to share it with anyone i feel. Just like i can with other consumables, food, car house, clothes, water, land etc. The voice on the cd is no longer the property of the singer because i have bought it. I think its not right to accuse me of eating my brothers property. If the voice on the cd is considered as the singers property then i am basically holding something as a loan. In this case it is not true.

Any opinions?

Actually u know i checked the site its ok there is no piracy on there COs its Streaming audio as oppose to a direct mp3 link!

I don't personally listen to any of the nasheeds or the artists mentioned in the thread so far but I thought I'd give my input inshaAllah.

Since it is streaming, then this should be ok inshaAllah.

The other issue is that Sami Yusuf uses instruments. This is haraam.

The only time Rasoolullah (saw) allowed the use of instruments was on the day of 'Eid and I have heard (not sure though) when Rasoolullah (saw) was making Hijrah to Madinah. But this was limited to duff (sort of drum) only.

InshaAllah the brother that designed the website, if you could take this naseehah (advice).

I as muslim should know this is god world and we belon to god, he do what he please, i should instead of judging pray to pray for me my family and all muslims, god help to forgive our sin, to forgive our tongue, our darken heart and mind for our action, to pray for our sisters and brothers who dies. what can we do then to unite all muslim accross the world and to say all together el latef el latef and to all to pray at the same time and to give our prayer to all who live in sufferance instead of judging a brother even if he killed, we have to learn to want goodness to our brothers and sisters then whishing mean things.

I step forward to say it, i am guilty and i am on my knees hoping god allah the only god to forgive me, and to help me to be in his path of islam, to help me to clean my heart from darkness. We are loosing our faith god help us help us yaa allah imani ya allah dini yallah lahla ya allah tajeallni nahrouj mine ta atika dinika yaa allah, kama halktini mouslim ajaalni narjeh laka ya lah mouslim, hayati rouhi imaani fi ayedika, wa anna inshaalah noussali ilaa laka ya allah, nahboudou ila laka wa nassha ila laka ya ilah.
