Not often that I repost CAIR press releases, but since this covers both Muslim community issues and tech issues, I thought this would interest any Muslim interested in buying Dell’s overpriced, overrated computers with that flaky operating system. All e-mail addresses have been spam-proofed.

DELL FIRES 30 MUSLIMS OVER MAGHRIB PRAYER
Contact Dell to urge rehiring of workers, mediation

(WASHINGTON, D.C., 3/10/05) - CAIR today called on Dell Computers to rehire 30 Muslims workers allegedly fired from a plant in Tennessee for seeking to perform Islamic prayers in the workplace, and offered to help the company and its employees reach a mutually-agreeable solution to the dispute.

CAIR said the workers were fired from a Dell facility in Nashville, Tenn., after they sought to perform the Maghrib prayer each day after sunset. (Because the Maghrib prayer is tied to a particular time of day, it requires greater flexibility and creativity on the part of employers and workers.)

“Given sufficient goodwill on the part of all those involved, both the employees’ legal right to reasonable religious accommodation and the employer’s right to maintain smooth operations in the workplace can be maintained,” said CAIR Legal Director Arsalan Iftikhar.

In a letter sent today to Dell President and CEO Kevin B. Rollins, Iftikhar asked that the Muslim workers be rehired pending resolution of the issues involved. He said CAIR staffers who have experience dealing with workplace religious accommodation are available to act as mediators between the Muslim workers and Dell.

CAIR publishes a booklet, called “An Employer’s Guide to Islamic Religious Practices,” designed to prevent just such incidents. The booklet is available by e-mailing pubs [at] cair-net.org. (Include name, address and phone number when requesting the booklet.) Title VII of the Civil Rights Act of 1964 requires an employer to accommodate religious practices unless it causes an “undue hardship.”

Contact Dell to request that they re-hire the Muslim workers pending a mutually-agreeable resolution of the dispute.

Well it's a good thing I am undecisive and have been delaying my purchase.

I think I''ll take up PheonixCG's offer to help me build one..

This is unbelievable.. how could they sack them, and 30 of them?! ..just for wanting to pray :(

well i can say that no1 in ma whole family has bought a dell computer coz there simply...umm...awful...

I really do believe this treatment was unfair and poorly handled.

As a compromise, could the employer not simply arrange the shift schedules of Islamic workers so it would not correspond to any prayer times?

Where I work, some roles include 24 hour surveillance of servers and important stuff, which can cost millions if something goes wrong for even a minute. Someone is required to be there at all times. Its all shift based. A brother I used to pray with during the day can no longer pray while he is at work or go to eat, he has to be there for his 8 hour shift.

Not that I'm justifying anything, i doubt Dell has to deal with such critical stuff anyway, and neither would anyone leave their workspace if they're on a shift based work.

I'm sure Dell will try and blow this whole thing up just to avoid the defamation it will bring to them.

May Allah protect the brothers in their Jihaad for their right and their livelihood.

Even though my manager is proper safe, and lets me work from home for Jummah too!!

This is my reason why I agree with Hizbut-Tahrir and many OTHERS because Muslims working under Non-Muslims will never have the LIBERTY to practice their religious obligations.

I have experienced the same problems in the US military including experiences after military service.

The only logical way we as Muslims could have a decent livelihood with religious obligations is to WORK HARD to reestablish the Khalifah.

everyone should boycott DELL its probebly owned by zionist anyways I never buy name brand PC's I buy the parts from family owned or small shops and put my computer togther and customize it for my online games.

i doubt if the issue is one of liberty, but why would anyone pay some one to pray, there are lunch times and break times in which prayers could be said.

Good choice, don't buy a Dell. A custom designed computer is always best, because then you can get an informed opinion of what is perfect for you and your needs.

Just remember to use these 4 component brand names in your consideration:

1. Asus - for a motherboard. (I only use Asus. 100 computers go out the door and I don't see 99 of them come back. Durable.)
2. Pentium - for a processor (AMD 64 Bit if you are a gamer)
3. Crucial - for RAM (solid and proven reliability)
4. Western Digital - for a hard drive. (Good warranty)

Middle Tennessee facilities. Be assured that Dell values diversity in
all aspects of our operations. That includes religious beliefs, and our
long-time practice is to accommodate different beliefs within the
requirements of our business operations. Our practice of accommodation
often exceeds that required by law, including providing workers both space
and time away from their jobs for religious observations, including
Muslim prayer.



Dell has a strong relationship with the Muslim community in Middle
Tennessee. Muslim leaders in Nashville have recognized Dell for its
practice of accommodation, including in news reports about this matter.
Contrary to some reports, workers at the Dell location in Nashville were
not fired for praying or asking to pray. In fact, some contract workers
left their jobs after a disagreement with their contract manager about
accommodation. We were aware of, concerned about and actively working
to address the issue prior to news reports.



We are confident we’ll be able to appropriately resolve this issue.
Several of the workers who left their jobs have already returned to Dell,
and we are working with our contract employer to bring back as many of
the other workers as possible.

That's all very melodramatic but your ire is misplaced. Did you even attempt to read the article?

Rather than villify an employer for making company rules that apply equally to all, why is Dell to be subject to your condemnation when it's employees are so thoughtless and selfish as to "walk away" from their responsibilities? A company also has responsibilities to meet production schedules and committments to process orders for delivery.

The employees clearly could have handled this in a more mature and responsible fashion.
