Walaykum as-salam.
Ask and help your father towards the Light and Truth of al-Islam. Make dua and pray to Allah, the Most Beneficient, for his well-being and that one day, insha'Allah, he sees the Seerat-al-Mustaqim.

actually i *think* he still can... if he is still muslim, even though he doesnt do the stuff he should...
i herd he cant...though it is scary...the "whabis" or salafies goto the length and say the salaf - ie you know companions and those after them...- actually considered the one who didnt pray without reason a non muslim - i dont know the backing for that...but sounds scary never the less...

in rulings i've read scholars classify missing prayers/not praying differently to completely abandoning prayer altogether and saying "no i aint gonna do that" sort of thing..
and i've never read any conditions to your father being your wali apart from him being muslim
search some of the Q&A sites sis..

Asalamu alaykum,
There is a difference between one who does not pray out of laziness and one who does not pray because he denies its obligation - one is sinful, the other is denying what is necessarily known for a Muslim and kufr. This is the position of the four Madhahib as far as I know.
And Allah swt knows best.
Assalmu alykum,
If a person DENIES that he has to pray 5 times a day (or denies any of the established faraaid (obligatory) actions), then is is a kafir, and there is consesus on this.
If a person deosnt pray out of laziness (although he admits he should be praying and that he is big time sinning by not praying) then the MAJORITY of the ulama and the salaf (the first 3 generations after the prophet peace and blessing of Allah be upon him) say that he IS still a muslim, but a sinful one. This is the view of Imam Malik, Imam Abu Hanifah and Imam Shafi.
However Imam Ahmed Bin Hanbal disagreed and said that although most actions that are fard that are missed on purpose out of laziness makes a person a sinner and NOT a kafir, the only exception is the fard salaah. If a person misses his fard salaah without a reason then he becomes a kafir. (this view of his instigated perhaps the greatest debate ever in the hisrtory of Islam between himself and imam shafi (and any debate between the likes of these 2 must have been BIG (but of course with adab and good will and they both repected each others opion, not like the debates we have today)))
The majority way is the best way according to the ahadith, so your father is still a muslim.
So considering that he is still a muslim then he can still be your wali as far as im aware.
And Allah knows best.
was salaam.
