View Full Version : Question about Zina
Dear Brothers and sisters,
How r u all? :)
I wanted to ask a question about zina. If 2 ppl - both muslim - had the intention of getting married but the brother refused to marry the sister straight away and this lead to zina - with at least a refusla from the sister engaging in the zina but then no force from either side prevented them from the zina, and yet, there was no marriage at the end of this relationship, what is the punishment and islamic ruling?
If the sister feels she has been played around with and her zina filled actions with the brother have given her so much regret and emotional despair and depression that she doesnt even deserve to wear the hijab, if she and when she repents to Allah - will she be forgiven?
If the brother had promised her to marry her- and never married her, obviously played with her heart. Is it wrong for her to feel she has been played with and never forgive the brother for his actions towards her after she repents? Will Allah forgive the brother? Would Allah forgive the brother if he had no intention of marrying this muslim sister and was basically lying to her about marrying her?
Thanks to All
yes its a sad and humiliating thing - but true

well obviously if the brother was not serious about marrying the sister, its a very cruel trick to pretend he was  & if he made out he was interested in marriage, with the intention of persuding her in zina, then this is also obviously very haram.
As for whether Allah will forgive him.... it would depend on whether he sincerely repents. It is a really bad thing to do, including loads of haram things such as lying and zina, BUT that doesn't mean Allah could never forgive him, because he is the ghafoor, the raheem and aslong as we do turn sincerely to him in repentence, he promised to forgive us :) whether the sister forgives him or not, is down to her although I would say that if she does stay soooo angry for him for years and years, she will do herself more harm than it is worth because so many negative feelings, anger, hate for someone etc are not good for your mental health, and will most likely make her more unhappy.
As I have heard before, forgiveness is not only a gift to the person someone forgives, but also to themself because it saves them from having to deal with all these negative feelings all the time.
As for the sister, I'm not exactly sure what you mean... because you said there was a refusal to engage in zina, so if she refused, thats rape  in which case it's not the sister's fault, obviously because noone should be held to account for something they did not under their own free will, if she was forced, its not sin on her according to fatawa that I've read... but then as you went on to say there was no force, I'm not sure what you mean?
If she did it willingly then clearly it is haram because engagement is not enough to allow people to have sex, as she must have known, it is only halal after nikaah. That doesn't mean Allah can't ever forgive her for it though, as with the brother if she sincerely repents to Allah feeling bad for the actions she's done, having stopped doing this sin and intending not to go back to this sin in the future then surely Allah will accept this repentence!
And as for the feelings about Hijab, sister this must be the whispers of Shaytaan... he often plays this trick, by telling people they are "not good enough" to wear hijab, or to pray or things like this, & these whispers should be ignored. He just wants to lead people into more sin, what good would taking off the hijab do in this situation? Inshallah the sister should seek refuge with Allah from these whispers :)
About the punishment... well I think when there is no sharia rule in force in a country, like how it is here in the UK, there is no way to inforce the Hadd punishments for offences, so what I have heard is that it is better for people to just sincerely repent and not to disclose their sins.
Sorry my reply got a bit long!! and please forgive me if I said anything wrong :) wa assalaamu alaykum wa rahmatullahi, wa barakatuhu :)

Asalamalaykum Amara
I want to help you with any advice or fatwa I can provide, InshaAllah
but unfortunately not right now. I'll get back to you though InshaALlah.
In the meanwhile Ponder upon this:
The words of ALLAH:
"God has said, `O son of Adam, so long as you call upon Me and ask of Me, I shall forgive you for what you have done, and I shall not mind. O son of Adam, were your sins to reach the clouds of the sky and were you then to ask forgiveness of Me, I would forgive you. O son of Adam, were you to come to Me with sins nearly as great as the earth and were you then to face Me, ascribing no partner to Me, I would bring you forgiveness nearly as great as it [i.e. the earth]'".
Read that and understand the meaning of it in your heart, you'll realise how mercyful ALLAH SWT is!
take care and have always have and hope in ALLAH.

Pre-martial relationships are haram to begin with. zina is merely a grave consequence of commiting this sin. Both should ask repentence from Allah and try to solve the social and emotional problems of this sin by marrying... fastish. Also I heard that we should replace our bad deeds with good deeds. You could perhaps fast for 30 days in repentance to Allah and Allah is most forgiving.
Im sorry i disagree...
In this case both the Muslim man and the woman must be stoned to death. End of story.
If that cant be done for whatever reason then i will not be the 1 to put forward a alternative or substitution etc - which Allah has not decreed and to which i would be liable to answer in the hereafter.
As for the sister being "played around" this is just as pathethic as the brothers promises of marriage. They should have been No relationship until the marriage -
im not a mufti or a alim but that is the Islamic answer if you look in the Quran/Sunnah - anything else is man-made and a bidah.
Lets not Kid ourselves, brothers and sisters, we all know the punishment of Zina.

stoned or lashes?

First of all a respectable sister would never give herself before being married... whatever he says or do...
There is a sequence of events that should happen ... you have to follow it...
If the two were in such a hurry ... leaving the famillies and not having parental consentement would have been better ... i.e get married then enjoy lawful actions between each other -as soon as possible- if necessary ...
As a matter of fact this thing happens quite often nowadays people want to go faster than they should ... This is why it is recommended that the sister keeps a a gap between her and the potential futur husband and keep away from his as long as they arent married ... and if sexual temptations are high -which would seem exagerated- then one can aways fast or find way of avoiding perpetrating fahisha or zina ...
But since the sister seems to have been 'duped' into zina by the guy I suggest she tres her best to contact him and force him to marry her ...
If not possible then due to the fact that they do not leave in an ISLAMIC STATE I think they will get away with it .... In this life
But rest assured not in the next ...
I believe these instances are due to the influence of kufr societies where the man dates the girl for a coupla years before they get married etc....
None of this would have been allowed in Muslim societies 40 years ago ...
The sister would be kept away from the bro until they get married ...

At the end of the day what was done was done...
and there is no turning back...
since the sister was consentant -not raped- she should try re-contact that fella ....
and marry him....
if the fella doesnt want to... then she has only herself to blame...
this is no time of being naive...
everybody wants to take advantage of everybody in this world...
And the parents share a good deal of blame for allowing her to see the dude before getting married ... meaning they should have kept an eye on their daughter... until the dude marries her...

My mistake, 100 Lashes.
Stoning to death is for married person(s).
Although may i add if done correctly the zinae should rarely survive the lashes.
Still if we cant implement the punishment decreed by Allah then that is our fault but we shouldent go proposing exotic alternatives -
what some people here have suggested is that they be married- this is what the Christians used to do in the middle ages... and look at them today - a society full of fornictors.

"Whatever of good reaches you, is from Allaah, but whatever of evil
befalls you, is from yourself."
Narrated by Ibn Umar : Allaah's Messenger (sallallahu alaihe wa-
sallam) said, "If Allaah sends punishment upon a nation then it
befalls upon the whole population indiscriminately and then they
will be resurrected (and judged) according to their deeds."
Whatever good comes upon us - blessing or security - it is from
Allaah, it is He who provided that, its beginning and end, from his
beneficence. It is He who granted us from his bounty that we should
carry out that which would lead to it, and it is He who granted us
His blessing and completed that for us. Many people today attribute
the misfortunes which befall them, whether relating to wealth and
economics, or security and political affairs to purely materialistic
causes. There is no doubt that this is due to their limited
understanding and weakness of their EEMAAN and their failure to
reflect upon the Book of Allaah and the Sunnah of His Messenger
(sallallahu alaihe wa-sallam). Behind these reasons are causes
prescribed as such by Allaah, However the material reasons may be a
means of bringing about what is due to the causes prescribed by
Allaah which necessitates the misfortune and punishment. Allaah, the
Mighty and Majestic says :"Evil (sins and disobedience of Allaah)
has appeared on the land and sea because of what the hands of men
have earned (by oppression and evil deeds etc.), that Allaah may
make them taste a part of that which they have done, in order that
they may return (by repenting to Allaah)."
"O Muslim! you are the best and most noble of the nations of Allaah,
the Mighty and Majestic. Allaah does not punish this nation for its
disobedience and sins in the way that He punished the previous
nations. He will not cause its destruction with a single
overwhelming punishment as happened to 'Aad, when they were
destroyed by the violent wind which He unleashed upon them for seven
nights and eight days in succession so that they were left lying
like the hollow trunks of palm trees, Do you see any remnants of
them.
Ibn 'Abbas narrates that the Prophet (sallallahu alaihe wa-sallam)
said "I was granted victory with As-Saba (Easterly Wind), and the
nation of 'Aad, was destroyed by Ad-Dabur (Westerly Wind)." and Anas
narrates that "Whenever a strong wind blew, anxiety appeared on the
face of the Prophet (sallallahu alaihe wa-sallam) (fearing that,
that wind might be a sign of Allaah's wrath)."
He will not destroy it (the ummah) with the like of the punishment
of Thamood who were seized by the terrible shout and the earthquake
so that they lay prostate corpses in their homes. And He will not
destroy it with the like of the punishment of the people of Loot,
against whom Allaah sent a violent wind and stones from the sky and
turned their homes upside down.O Muslims ! Allaah, from His Wisdom
and his Mercy, punishes this nation for its sins and disobedience by
setting some part of it upon the others so that they destroy one
another and take each other prisoner, Allaah, the Mighty and
Majestic, says "Say : 'He has power to send torment on you from
above you of from under your feet, or to cover you with confusion in
party strife, and make you to taste the violence of one another.'
See how variously We explain the Ayaat, so that they may
understand. But your people (O Muhammed (sallallahu alaihe wa-
sallam) have denied it (the Qur'aan) though it is the truth.
Say : 'I am not responsible for your affairs.'For every news there
is a fact (i.e. for everything there is an appointed term and you
will come to know)."
It is also reported by Sa'd ibn Abee Waqqaas, who said : "We went
along with Allaah's messenger (sallallahu alaihe wa-sallam) until we
came to the mosque of Banoo Mu'aawiyah, so Allaah's Messenger
(sallallahu alaihe wa-sallam) entered and prayed two rak'ahs so we
prayed along with him, so he called upon his Lord for a long time,
then said : 'I asked my Lord for three things, I asked him that He
should not destroy my nation with a deluge so He granted me that; I
asked Him that He should not destroy my nation with famine as
happened to the people of Fir'awn so He granted me that; and I asked
Him that they should not fight amongst themselves, but He refused
me that."
Misconceptions Cleared
There are some people who doubt and seek to cause doubts that sins
are a cause of misfortunes, and that is because of the weakness of
their eeman and their negligence in reflecting upon the book of
Allaah, the Mighty and Majestic as Allaah of the says in the
Qur'aan,"And if the people of the towns had believed and had taqwaa
(Piety), certainly, We should have opened for them blessing from
the heavens and the earth, but they belied (The messengers). So we
took them (with punishment) for what they used to earn (polytheism
and crimes etc). Did the people of the towns then feel secure
against the coming of Our punishment by night while they are
asleep ? Or, Did the people of the towns then feel secure against
the coming of Our punishment in the forenoon while they play ? Did
they then feel secure against the plot of Allaah.None feels secure
from the plot of Allaah except the people who are lost."
Daawah to the Ummah
Sins affect the security of a land, they affect its ease, its
prosperity, its economy and they affect the hearts of its people.
Sins
cause alienation between the people. Sins cause one muslim to
regard
his muslim brother as if he were upon a separate religion other
than
Islaam. But if we sought to rectify ourselves, our families, our
neighbours and those in our areas, and everyone we are able to
rectify
, if we mutually encouraged good and forbade evil, if we assisted
those
who do this with wisdom and wise admonition then it would produce
unity
and harmony.Allaah the Mighty and Majestic says : "Let there arise
out
of you a group of people inviting to all thatis good (Islaam)
enjoining
the ma'roof and forbidding the munkar. And it is those who are
successful. And be not as those who divided and differed among
themselves
after the clear proofs had come to them.It is they for whom there is
an
awful torment."
Al-mugheerah ibn Shu'bah related that the Prophet (sallallahu alaihe
wa-sallam) said "A group of my followers will remain victoriously
upholding the truth until Allaah's order (the last hour) comes on
them while they are still Victorious." It is reported by Zaid ibn
Thaabit that the Prophet (sallallahu alaihe wa-sallam)
said "Allaahblesses any man who hears a saying of mine, memorises
it and understands it, then conveys it just as he heard it. "O
Servants of Allaah ! Fear Allaah, the Mighty and Majestic, and
beware of neglecting the prescribed laws of Allaah, beware of
neglecting Allaah signs, beware of failing to reflect upon the book
of Allaah, beware of failing to know the Sunnah of Allaah's
Messenger (sallallahu alaihe wa-sallam), since in the Book of Allaah
and the Sunnah of his Prophet (sallallahu alaihe wa-sallam) lies
your success (if you cling to them, if you attest to the truth of
what they inform of and follow their commands). And since we have
been looking at them from a materialistic perspective the
unbelievers are stronger and greaterthan us through that. However if
we look from an Islamic perspective by the way of the Qur'aan and
the Sunnah then we will abandon all that is a cause ofthese
misfortunes as Allaah says:" Verily , Allaah will help those who
help His (cause) Truly, Allaah is All-Strong, All-Mighty."
Some of the 'Symptoms, Avoidance & Cures' of Sins :
Narrated by Abu Huraira, The Prophet (sallallahu alaihe wa-sallam)
said "Avoid the seven great destructive sins" the people asked O
Allaah's Messenger ! what are they ? He said "To join others in
worship along with Allaah, to practice sorcery, to kill the life
which Allaah has forbidden except for a just cause, to eat up Riba
(usury, interest), to eat up an orphan's wealth, to show one's back
to the enemy and fleeing from the battlefield at the time of
fighting and to accuse chaste women, who never even think of
anything touching their chastity and are true believers".
Narratedby Abdullah bin Amrthat the Prophet (sallallahu alaihe wa-
sallam) said "Whoever has the following four (characteristics) will
be a pure hypocrite and whoever has one of the following four
characteristics will have one characteristic of hypocrisy unless
and until he gives it up.
1. Whenever he is entrusted, he betrays (proves dishonest).
2. Whenever he speaks, he tells a lie.
3. Whenever he makes a covenant, he proves treacherous.
4. Whenever he quarrels, he behaves in a very imprudent, evil and
insulting manner ."
Narrated by 'Aishah that the Prophet (sallallahu alaihe wa-sallam)
said "The most hated person to Allaah is the one who is most
quarrelsome of
the opponents"
Narrated by Abu Huraira that Allaah's Messenger (sallallahu alaihe
wa-sallam) said "Part of a man's good observance of Islaam is that
he leaves the things which do not concern him" ( i.e. avoiding
interference with other's matters).
Narrated by Ibn Abbas that AllaahMessenger (sallallahu alaihe wa-
sallam) passed by two graves and said "Both of them are being
tortured, and they are not being tortured for a majorsin. This one
used not to save himself from being soiled with his urine, and the
other used to go about with calumnies"
The Qur'aan
Narrated by Uthman, The Prophet (sallallahu alaihe wa-sallam)
said "The best among you (Muslims) are those who learn the Qur'aan
and teach it (to others)"
Ibn Masood reported that the Prophet (sallallahu alaihe wa-sallam)
once said "Whoever reads a single letter from Allaah's Book will
receive a blessing and each blessing is worth ten times its
value."Abu Umaamah reported that the Prophet (sallallahu alaihe wa-
sallam) said "Recite the Qur'aan for verily on the Day of
Resurrection it will act as an intercessor for its companions (those
who read it often).
Prayer ( Salat )
To offer salat at its appointed time as narrated by Abdullah
ibnMasud 'I asked the Prophet (sallallahu alaihe wa-sallam) Which
deed is the dearest to Allaah? He said, "To performs-Salat at their
early fixed times......."Bearing in mind salat is to performed as
the prophet ordered us to pray "Perform your salat the way you see
me performing them"
Fasting (Saum) and Charity (Sadaqah)
Mu'adh bin Jabal narrates: "The Prophet (sallallahu alaihe wa-
sallam) said to him "May I show you the gates of goodness ?
(They are) Fasting is a screen from hell, As-Sadaqah extinguishes
the sins as the water extinguishes the fire, Standing in prayer by a
slave of Allaah during the last third part (Tahajjud) of a night"
Then the Prophet (sallallahu alaihe wa-sallam) recited
(V.32:16) "Their sides forsake their beds". Abu Huraira narrates
that the Prophet (sallallahu alaihe wa-sallam) said "Everyday two
angels come down from the heaven and one of them says 'O Allaah !
Compensate every person who spends in your cause,' and the other
(angel) says, 'O Allaah ! Destroy every miser.' "
Seeking Knowledge
Reported by Anas "Seeking knowledge is obligatory on every Muslim"
Reported by Abu ad-Dardaa that he heard the Prophet (sallallahu
alaihe wa-sallam) say "If anyone travels on a road in search of
knowledge, Allaah will cause him to travel on one of the roads of
paradise. The angels will lower their wings because of their pleasure
with one who seeks knowledge, and forgiveness will be asked for him
by the inhabitants of the heavens and earth and the fish in the
depth of the oceans..."
Adhering to the Sunnah
Reported by Abu Huraira that the Prophet (sallallahu alaihe wa-
sallam) said "I have left with you two things, if you hold on firmly
to them , you will never go astray; Allaah's Book and my Sunnah."Abu
Huraira narrates that Allaah's Messenger (sallallahu alaihe wa-
sallam) said, "All my Ummah will enter paradise except those who
refuse" They asked O Allaah's Messenger ! who will refuse ? He
Said "Whoever obeys me will enter paradise, and whoever disobeys me
is the one who refuses (to enter paradise)"
Avoiding Bidah (Innovation)
Abdullah ibn Masoud relates that Allaah's Messenger (Pubh) drew a
line for them one day and then Said "This is Allaah's path", then he
drew several lines (branching off) to the right and to the left and
said, "These are the paths (of Misguidance) on each of which is a
devil inviting people to follow it" andthen he recited (the
verse) "Verily this is my path, leading straight, so follow it. And
do not follow the (other) paths for they will scatter you about from
(Allaah's) path. This is His Command to you in order that you may be
conscious of Allaah."
Aisha reported that the Prophet (sallallahu alaihe wa-sallam)
said "Whoever introduces something new into this religion of ours
which does not belong in it will have it rejected" (i.e., it will
not be accepted by Allaah.
Imitating the Kufaar
The Prophet (sallallahu alaihe wa-sallam) has warned us in regards
to imitating the Kufaar, Abu Saeed al-Khudree reported that Allaah's
Messenger (sallallahu alaihe wa-sallam) said "You will follow the
practices of yourpredecessors, inch by inch and yard by yard, so
much so that if they were to enter a lizard's hole you would also
follow them." He then asked if he meant the Jews and the Christians
and He replied "Who Else ? "
The Prophet (sallallahu alaihe wa-sallam) also warned us
saying "Whoever resembles a people, he is one of them" The Prophet
(sallallahu alaihe wa-sallam) also cursed men who tried to resemble
woman and women who tried to resemble men.
We ask Allaah, the Most High, that He turns the misguided of this
Ummah back to the guidance, and that he makes us all to support one
another and aid one another in carrying out good and righteousness
until we return to this Ummah its lost glory and honour, Indeed He
is fully able and having the power to do that.

Remind me never to come to you for judgement
Sahih Bukhari, Volume 8, Book 82, Number 812:
Narrated Anas bin Malik:
While I was with the Prophet a man came and said, "O Allah's Apostle! I have committed a legally punishable sin; please inflict the legal punishment on me'.' The Prophet did not ask him what he had done. Then the time for the prayer became due and the man offered prayer along with the Prophet , and when the Prophet had finished his prayer, the man again got up and said, "O Allah's Apostle! I have committed a legally punishable sin; please inflict the punishment on me according to Allah's Laws." The Prophet said, "Haven't you prayed with us?' He said, "Yes." The Prophet said, "Allah has forgiven your sin." or said, "....your legally punishable sin."
Also, remind me of a single occasion when the Prophet, solla Allahu alayhi wassallam, passed a judgement of Allah's punishment on a doer of Zina who
(a) did not confess
(b) did not ask for judgement by Allah's Shariah
Sahih Muslim, Book 035, Number 6518:
Abu Huraira reported Allah's Messenger (may peace be upon him) as saying:
He who alleviates the suffering of a brother out of the sufferings of the world, Allah would alleviate his suffering from the sufferings of the Day of Resurrection, and he who finds relief for one who is hard pressed, Allah would make things easy for him in the Hereafter, and he who conceals (the faults) of a Muslim, Allah would conceal his faults in the world and in the Hereafter.
Allah is at the back of a servant so long as the servant is at the back of his brother, and he who treads the path in search of knowledge, Allah would make that path easy, leading to Paradise for him and those persons who assemble in the house among the houses of Allah (mosques) and recite the Book of Allah and they learn and teach the Qur'an (among themselves) there would descend upon them the tranquillity and mercy would cover them and the angels would surround them and Allah makes a mention of them in the presence of those near Him, and he who is slow-paced in doing good deeds, his (high) descent does not make him go ahead.
Sahih Bukhari, Volume 9, Book 90, Number 341:
Narrated Sa'd bin Ubaid:
(the Maula of 'Abdur-Rahman bin Azhar) Allah's Apostle said, "None of you should long for death, for if he is a good man, he may increase his good deeds, and if he is an evil-doer, he may stop the evil deeds and repent."
'Reaching out'- you dont have to come to me for judgement, you just have to look in the Quran and the Sunnah.
---
From the Quran:
Sura: Al.Israa (17) Verse: 32:
WA- LAA TAQRABO AZ- ZINAA 'INNA -HU KAANA FAAH.ISHAH WA- SAA'A SABEL(AN)
"And come not near to the unlawful sexual intercourse. Verily, it is a Fahishah"
From Sahih Hadith:
-------
It is narrated that Maa'idh ibn Maalik al-Aslami came to the Prophet (Sallallaahu Alayhi Wasallam) while he was in the mosque and confessed of his sin saying: 'O Messenger of Allah, I require you to cleanse and purify me of this evil.'
The holy Prophet (Sallallaahu Alayhi Wasallam) turned away from him and sent him away saying, 'Go back and seek forgiveness of Allah Ta'ala and turn to Him penitently.'
Maa'idh retired to a little distance away from the Prophet (Sallallaahu Alayhi Wasallam) and approached him again saying, 'O Messenger of Allah, purify me.' Maa'idh received the same reply from the Prophet (Sallallaahu Alayhi Wasallam) until he made this confession for the fourth time.
The prophet (Sallallaahu Alayhi Wasallam) asked him, 'From what shall I purify you?' He said, 'From adultery'. The prophet (Sallallaahu Alayhi Wasallam) asked, 'Is he gone insane?' He was informed that this person was perfectly normal. Then he enquired, 'Has he drunk wine?' A man got up and smelt his breath and found that there was no traces of alcohol in it. He asked, 'Have you committed adultery?' 'Yes' he said. Only then did the holy Prophet (Sallallaahu Alayhi Wasallam) give instructions for Maa'idh to be stoned to death.
-------
-----
Abdullah ibn Umar (Radhiallaahu Anhu) narrated that the Jews came to the Messenger of Allah and stated that a man and a woman from among them had committed adultery. The prophet (Sallallaahu Alayhi Wasallam) enquired, 'Did you not find the injunction of stoning to death in your Torah?' They replied, 'We merely disgraced them and they are whipped.' Abdullah ibn Salaam (who was still a Jew at that momemtn but later converted to Islam) interrupted by proclaiming, 'You have lied. Verily, the Torah mentions stoning to death.'
Then the Torah was brought and it was opened. One of them put his hand over the verse of stoning to death and only read what was before and after it. Abdullah ibn Salaam said, 'Raise your hand, and when his hand was raised, the relevant verse became indistinguishable.
They said, 'He has spoken the truth, O Muhammad, therein is the verse of stoning to death, but we conceal it amongst us.' Thereafter, the prophet (Sallallaahu Alayhi Wasallam) instructed that both of them be punished in accordance with the law of the Torah.'
--------
'A woman from Ghaamid came to the prophet (Sallallaahu Alayhi Wasallam) and said, 'O prophet of Allah (Sallallaahu Alayhi Wasallam) I have committed adultery so purify me.' The prophet (Sallallaahu Alayhi Wasallam) sent her away. The following day she returned and said, 'O prophet of Allah (Sallallaahu Alayhi Wasallam), why do you turn me away? Perhaps you turn me away as you turned away Maa'idh. By Allah, I have become pregnant.' He said, 'Well, if you insist upon it, then go away until you give birth to the child,' When she delivered she came with the child wrapped in a rag and said, 'Here is the child whom I have given birth to.' He said, 'Return and suckle him until you wean him.' When she had weaned her child she came to him with the child who was holding a piece of bread in his hand. She said, 'O Prophet of Allah (Sallallaahu Alayhi Wasallam), here he is. I have weaned him and he eats food.' The holy Prophet (Sallallaahu Alayhi Wasallam) entrusted the child to one of the Muslims and thereafter pronounced punishment. While stoning her, some blood fell on Khalid ibn Walid's face who rebuked and cursed her so loudly that the Prophet (Sallallaahu Alayhi Wasallam) overhead him. The prophet (Sallallaahu Alayhi Wasallam) said, 'Softly O Khalid, this woman has repented so sincerely that if it were to be divided among seventy people of Madinah, it would have been sufficient for their salvation.'

Bukhari: Volume 7, Book 63, Number 196:
Narrated Abu Huraira:
A man from Bani Aslam came to Allah's Apostle while he was in the mosque and called (the Prophet ) saying, "O Allah's Apostle! I have committed illegal sexual intercourse." On that the Prophet turned his face from him to the other side, whereupon the man moved to the side towards which the Prophet had turned his face, and said, "O Allah's Apostle! I have committed illegal sexual intercourse." The Prophet turned his face (from him) to the other side whereupon the man moved to the side towards which the Prophet had turned his face, and repeated his statement. The Prophet turned his face (from him) to the other side again. The man moved again (and repeated his statement) for the fourth time. So when the man had given witness four times against himself, the Prophet called him and said, "Are you insane?" He replied, "No." The Prophet then said (to his companions), "Go and stone him to death." The man was a married one. Jabir bin 'Abdullah Al-Ansari said: I was one of those who stoned him. We stoned him at the Musalla ('Id praying place) in Medina. When the stones hit him with their sharp edges, he fled, but we caught him at Al-Harra and stoned him till he died.

With respect i think some people miss how Grave the Sin Zina really is in Islam. The people mentioned in Hadith who admitted to Zina were by todays standards brave beyond belief! For who would today admit to such an act? They had guts and they had faith which is rarely seen. Yet the Prophet (saw) could not forgive them after the conditions had been met, take note of what he said to Khalid bin Waleed regarding the woman from Ghaamid "this woman has repented so sincerely that if it were to be divided among seventy people of Madinah, it would have been sufficient for their salvation". But still the Prophet (Saw) had to carry out the will of Allah.
and what is the will of Allah?...
AZ- ZAANIYAH WA- AZ- ZAANE FA- IJLIDO KULL WAAH.ID MIN -HUMAA MI'AH JALDAH WA- LAA TA'KHUDH -KUM BI- -HIMAA RA'FAH FE DEN 'ALLAAH 'IN KUNTUM TU'MINON BI- 'ALLAAH WA- AL- YAWM AL- 'AAKHIR WA- LI- YASHHAD cADHAAB -HUMAA T.AA'IFAH MIN AL- MU'MINEN
"The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allah, if you believe in Allah and the Last Day. And let a party of the believers witness their punishment."

Indecent Practices: Sinned with a friend, repented, can we still stay in touch?
--------------------------------------------------------------------------------
Answered by Shaykh Nazim Mangera
Question:
This is the situation: Two Muslim women, being best friends and room mates have had a sexual relationship. One of these two women have had major surgery on her brain. Both women had made tawbah never to do any haram again. Still living together, they had gone back on their tawbah and started having a relationship again. This relation has been on and off because both women know that what they have been doing is haram. The other woman also had a stroke but still they kept on doing haram on and off...both women have been struggling with themselves and in doing what's right. Both women now live separately as they had both decided that it's best for their friendship. One of these two women is getting married soon inshaAllah and the other will move on as well with her life. The bond of friendship between these two women is very strong as they have both done wrong and they want to do right....together.
My question is: If they are both sincere in their tawbah to Allah and they realize that they have to move on with their lives... is it possible for them to have an honest and pure friendship based on goodness, and honesty and trust in Allah? Can they see each other to have some coffee? Can they visit each other? Can they talk on the phone? Can they stay in contact with each other at all in any way?
--------------------------------------------------------------------------------
Assalamu Alaikum,
Once a person has repented over their sins, it would be better for the person to stay away from the person who he/she committed the sin with. It will facilitate their path towards complete spiritual cleanliness. Since the two have had a dark past with each other, it would be strongly advisable for them to move on in life and cut off all contacts with each other. Satan is our sworn enemy and he has avowed to take every single human being to the hell fire. Dont give him the chance again to take the two of them away from Allah. Talking with each other and staying in contact with each other just might rekindle and reignite that feeling which they had for each other. Its better to be safe than sorry.
Allah states in the Noble Quran, And (remember) the Day when the wrong-doer will bite at his hands, he will say: Oh! Would that I had taken a path with the Messenger (Muhammad Sallallahu Alaihe Wasallam). Ah! Woe to me! Would that I had never taken so-and-so as a friend! He indeed led me astray from the Message (of Allah) after it had come to me. And Satan is ever a deserter to a human being in the hour of need. (Surah 25:27~29)
Every saint has a past, every sinner has a future.

salam all - thanks for ur replies. Another thing i wanted to mention, i dont think i was clear in the post. The sister hasnt committed the worse zina....i mean as in intercourse but everyhtign else related to that.
Finally, the sister is someone close to me - not me. and another question - does she still need to be lashed 100 times and doesn everyone have to know about it - and can it be done in privacy?
another thing - the sister kept telling the brother that they should get married before even one touch - but the brother kept telling her that his parents will not approve of him speaking to the girls parents right now because they were of diffferent nationalities. and he wanted to wait until he finished his univ. degree and have some power to be able to go against his parents wishes.
its pretty stupid, but as som1 said in the forum - wat is done is done.

what is zina? is kissing smooching and hugging considered as zina? or is the insertion of male sex organ in to female's considered as zina?
kindly elaborate on zina, is kissing smooching and hugging considered as zina? or is the insertion of male sex organ in to female's considered as zina?
Answer 10473 There are many different levels of Zina.
The highest and the worst type would be sexual intercourse and it is to this type that the punishment of stoning or lashing will apply.
Looking at a female who is haraam to one, listening to her voice without necessity, speaking to her, touching her and walking towards her are all forms of Zina and are sins albeit lesser than intercourse.

What is Sincere Repentance
How do you know if you are truly repentant? because I always feel bad for my sins & ask forgiveness - (all past sins) but then I think 'am I only saying I'm sorry so I don't go to hell or because I'm really sorry for it??'
Walaikum assalam,
Allah Most High says, "Turn towards Allah, O believers, every one of you, so that you may be successful." (24:31)
And He says, "Ask your Lord for forgiveness and then turn in repentance to Him," (11:3) and He says, "O you who believe! Turn in sincere repentance to Allah." (66:8)
The Prophet (Allah bless him & give him peace) said, The one who repents from sin is like the one who never sinned. [Ibn Maja (3240)] He also said, Remorse is repentance. [Ibn Maja (4242) and Ahmad (3387)]
Abu Hurayra (Allah be pleased with him) reported that the Messenger of Allah (Allah bless him and give him peace) said, "Allah will turn towards anyone who turns in repentance before the sun rises from the place it set." [Muslim]
Imam Barkawi, the great Ottoman Hanafi faqih, grammarian, and sufi, defined repentance (tawba) in his Tariqa al-Muhammadiyya as,
Going back from desire to sin, with the determination of not returning to it, in exaltation of Allah and out of fear of His punishment. [al-Bariqa fi Sharh al-Tariqa, 3.139]
The Conditions for Repentance
The conditions for repentance are well known:
1Leaving the sin;
2)Remorse over having committed the sin;
3)Resolve never to return to the sin;
4)If it relates to the rights of another person, then to) Return the rights or property one wrongly took. [al-Bariqa fi Sharh al-Tariqa; Riyad al-Salihin]
If these conditions are truly met, then one can expect one's sins to be forgiven. However, one has to be very careful about how sincere one is in fulfilling one's conditions. It is recommended to seek forgiveness a lot, and to repent every time the sin comes to one's mind.
If one keeps repeating the sin, then one should find the root cause(s) of the sin and eliminate them. For example, if one falls into a certain sin because of the company one keeps, then it would be necessary to either stop keeping their company, or to change the nature of one's relationship with them.
So, what is true repentance?
Ibn Hajar mentioned that Qurtubi quoted 23 different definitions of true repentance (al-tawba al-nasuh) in his tafsir. Ibn Hajar mentioned the most important of these:
1. Umars words (Allah be pleased with him) that it is, To sin and then never to return to it.
2. To hate the sin, and the seek forgiveness for it every time it occurs to one, as Hasan al-Basri (Allah have mercy on him) said.
3. Qatadas words (Allah have mercy on him), To be genuine and truthful in ones repentance, which is what Imam Bukhari chose as the definition of true repentance in his chapter heading.
4. To have sincerity in ones repentance.
5. To be concerned about ones repentance not being accepted.
6. To be such that it does not need another repentance after it.
7. To be made out of fear and hope, and be accompanied by consistency in worship.
8. Like the seventh, but with the added condition that one desert those who assisted one in sin.
9. That ones sin be between ones eyes. [f: That is, one does not forget it.] [Ibn Hajar, Fath al-Bari]

Zina
[ADULTERY/FORNICATION]
Allāh Taāla says: "And do not go near zina. It is indeed a shameful and an evil path." (Surah Al Isrā, Ayah 32)
Allāh Taāla says: "The woman and the man guilty of fornication - lash each of them with a hundred lashes. Let not compassion move you in their case, in a matter prescribed by Allāh, if you believe in Allāh and the Last day and let a group of believers witness their punishment". (Surah Al-Nūr, Ayah 2)
Rasūlullah PBUH Said: "
adultery of the eyes is when it looks at that which is Harām; adultery of the ears is when it listens to that which is Harām; adultery of the tongue is when it utters Harām; adultery of the hands is when it touches Harām; adultery of the feet is when it walks towards Harām; adultery of the heart is when it desires and hopes for that which is Harām; adultery of the private parts is when it succumbs to that which is Harām." (Targhib wa Tarhīb)
From the above Hadīth it is clear and apparent that Islam forbids not only the act of adultery but all acts that invite and encourage the act of zina. Islam shuts the door to the root of every evil.
Nabī SaLalahu alaihi wasalam said:
"There are three such people with whom Allāh Taāla will not speak to (with words of mercy and kindness) nor will Allāh Taāla look at them (with eyes of mercy) nor will Allāh Taala purify them, and for them is a painful punishment:
* An old person who commits zina.
*A king or leader who is exceptionally deceptive (he lies a lot).
*A needy person who is proud."
(Muslim)
Once Nabī SaLalahu alaihi wasalam remarked: "A dayyūth [cuckold] will never enter Jannah." The Sahāba enquired, "Who is a Dayyūth?" Nabī replied, "A man who is not bothered about who visits his wife."
(Sunnats)
Touching a Strange Woman with Lust
It has been reported that the person who touches a strange woman with lust, on the day of resurrection his hands will be shackled to his neck.If he kissed her ,his lips will be cut off and thrown in the fire of Jahannum. If he committed adultery then his thighs will bear witness to it and testify against him on the Day of Qiyāmat. It will say to him, "I was mounted for something impermissible." Allāh will look at him with anger. The flesh of his face will fall off and he will proclaim "What did I do?" His tongue will testify and say, "I spoke to whom it was not permissible for you to talk to." His legs will testify, "I walked towards something unlawful." His hands will testify "I held something which was prohibited for you." His eyes will testify "I gazed at unlawful things." His private parts will testify "I committed the act." An angel will say, "I heard it" while another will say, "Ive written it down." Allāh will say "I was aware of it and I concealed it." Then Allāh will say to the angels "Let him taste of my punishment. My anger has increased on one who has no shame."(Kitāb-ul-Kabair)
In a Hadīth narrated by Samurah (RA) regarding a dream of Nabī SaLalahu alaihi wasalam it is mentioned that Jibraīl and Mikāīl (AS) came to Nabī SaLalahu alaihi wasalam:
Nabī SaLalahu alaihi wasalamsays:
"We walked until we came to something that looked like an oven. Its top section was narrow and the inside was broad. From it sounds of screaming and noise was heard."
Nabī SaLalahu alaihi wasalam further says: "We looked inside and we saw naked men and women. We also saw flames from beneath them. When these flames scorched them, they screamed." I asked Jibraīl (AS): "Who are these people?" He replied, "These are the males and females who committed the grave act of zina. This will be their punishment till the day of Qiyāmat." (Bukhari)
The Harms of Zina [Adultery/Fornication] are Manifold
Allāh Taāla becomes very angry.
1)The reckoning in the hereafter will be very severe.
2)The person will enter Jahannam.
3)The barakāh (blessing) of his rizq is lost.
4)He is deprived from doing good.
5)He becomes hated and cursed in the eyes of the common people.
6)The nation involved in Zina will be afflicted with droughts.
7)The spreading of diseases and plagues.
8)The destruction of the locality.
9)The cause of earthquakes.
10)The birth of illegitimate children.
The Result of Young Peole of Marriageable Age who Do Not Get Married
When there is no taqwa (fear of Allāh) in an unmarried persons life, the passions of such a person are fulfilled in one of the following ways:
1)Having unlawful relationships with men or women.
2)Having mistresses.
3)Visiting escort agencies and prostitutes.
4)Frequenting clubs or discos.
5)Reading pornographic material.
6)Gazing at women with lust.
The Solutions
To make nikāh. Nikāh in Islām is very simple, easy and full of barakāh. If one cannot make nikāh due to some sharī reason, he/she should resort to the following:
Keep fast.
1) Protect the eyes from looking at strange men/women.
2) To avoid mixed gatherings.
3) To have the thought that Allāh is at all times watching and aware of your actions.
4) To refrain from sitting and working in privacy with strange women.
5) Males should fulfill the rights of their wives i.e. looking after them. This will prevent women from treading the wrong path.
6) To be wary of the dictates of the nafs.
7) Women should fulfill their husbands rights and should not make excessive demands on them.
8) To ask Allāh for protection from disobedience.
A Youth Seeks Permission to Commit Adultery
A youth (from the outlying regions) came to Nabī Salalahau alaihi wasalam and said: "Please permit me to commit adultery." The Companions of the Nabī Salalahau alaihi wasalam took this very ill and were enraged at his words; but Nabī said to him: "Come nearer to me. Would you like anyone to commit adultery withyour mother?" He said: "Not at all." Nabī said: "Then other people will also never tolerate such a shameful act with their mothers." Then Nabī asked him the same question abouthis sister, aunt, etc. And he answered each time in the negative. Then Nabī put his hand on his chest and prayed: "O Allāh! Purify his heart, forgive his sins and guard him against adultery." The reporters say that, after this, nothing was more hateful to him than adultery.
thanku for ur reply intuition, it was very heplful. So wat is the punishment in this world for zina excluding s..xual intercourse? The sister is wanting to get punished for her bad deeds as she feels she cannot go on with her life and feels guilty and wants to be punished for it. She is severly depressed and wants to turn back to Allah and she feels that He will not forgive her for just repenting.
She wants to be lashed 100 times if possible. But she doesnt know who by. Who may punish her? If there is no other witness, will Allah forgive her? If she is punished with 100 lashes and repents sincerely, will she be forgiven in the next world or will she still go to jahannam?

as salam alykom
In this case, wa Allah u a`alem, she simply should not scandilize herself, even in the cases of zina in the sense of zina the Messenger advised poeple after Maez was stoned to conceal themselves.
Also in the case of Abul Yosr Kaab Ibn Amr Al Ansary who was selling dates when a woman came to him and he took her home telling her there are better dates.
He was able to kiss her and she told him to fear Allah, he felt terrible, went and told Abu Bakr who asked him did u tell anyone else, he said no, Abu Bakr said then just conceal yourself. He went and told Omar who asked the same question, he said I told Abu Bakr, Omar said what did he tell u, he said not to tell anyone, Omar said then why r u telling me.
The man still couldnt stand the sin (mind u he is one of those who fought Badr). He went and told the Messenger after joining Asr prayer in the masjed. The Messenge (sallah Allah a`alyhee wa sallam) kept quite. The man left in a terrible state, while he was walking away, Allah revealed the Ayah:" And perform As-Salāt (Iqāmat-as-Salāt ), at the two ends of the day and in some hours of the night [i.e. the five compulsory Salāt (prayers)]. Verily, the good deeds remove the evil deeds (i.e. small sins). That is a reminder (an advice) for the mindful (those who accept advice). [2]" (Quran 11:114)
