THE QURAN & SUNNAH AS SOURCES OF LAW By Sidi (Dr.) Yasin Dutton (University of Edinburgh)*

There is no doubt that the two main sources of Islamic law (Shari'ah)
are the Qur'an and the Sunnah but very few Muslims understand what is
involved in deriving legal proscriptions. How important are they?
Questions are being posed by some Muslims about the need to reform
the Shari'ah in light of the so-called 'Enlightened' Modern Age. Is
it a matter of just reading the Qur'an and the hadiths literally and
arriving at a legal verdict. If that were the case, it would explain
why there are so many DIY Mujtahids (self acclaimed legal jurists)
today! Or is there more to it? By working through some real life
examples Dr Yasin Dutton will illustrate the importance of these
sources and how legal judgements are derived from the Qur'an and
Ahadith.

* Dr Yasin Dutton was educated at Jesus College, Oxford University,
where he received both his first degree, in Arabic and Urdu, and his
doctorate on Early Islamic Law. Having taught for some years at the
Oriental Institute in Oxford, he was appointed to his present post
at the University of Edinburgh in 1995. In addition to early Islamic
law, his current research interests include the different readings of
the Qur'an and how these are reflected in early Qur'anic manuscripts,
Islam and the Environment, Islamic Economics, and the Application of
Fiqh in the Modern World. Dr Yasin subscribes to the Maliki School
of Fiqh and is regarded by some as a world authority on this school
of Jurisprudence. He has served as an imam of the Central Masjid in
Norwich. He is currently a Senior Lecturer in Arabic and Islamic
Studies as well as Head of the Department of Islamic and Middle
Eastern Studies at the University of Edinburgh, Scotland.
