8. That the exclusion of part time workers from employment rights is indirectly discriminatory against women was established in R -v- SECRETARY OF STATE FOR EMPLOYMENT ex parte EOC [1995] AC 1 HL and that the exclusion of the female applicants from access to occupational pension schemes is indirectly discriminatory is conceded by all the respondents. It is common ground that sections 6(1A)(a) and (b) of the Equal Pay Act and section 118 of the Pension Schemes Act 1993 (the equal access requirements) when read together have the effect of prohibiting only direct discrimination between the sexes with regard to the provision of access to occupational pension schemes and consequently of excluding the applicants from the protection of the equality clause to be implied into every contract of employment by virtue of section 1 (1) of the Equal Pay Act.
The applicants thus have no right of action under UK law in respect of their exclusion from schemes prior to the -31st May 1995 when the offending provisions was removed by _sections 62 and 63 of the Pensions Act 1995.

It is also common ground that the exclusion of the female applicants from occupational pension schemes breaches the provisions of Article 119 of the Treaty of Rome, the principle of equal pay for equal work, and that following DEFRENNE -v- SABENA (No 2) [1976] ECR 455 ECJ, with effect from 8th April 1976, the provisions of that Article being of direct effect the applicants have a cause of action under European law. But there consensus ends.
10. The jurisprudence of the inter-relationship between European law and the laws of the Member States is still evolving. In their skeleton argument Counsel for the applicants cite three alternative approaches: that the relevant domestic law applies subject to the disapplication of provisions which conflict with European law: that European law gives rise to free-standing rights of action onto which are en grafted the time limits and other procedural matters from the nearest analogous domestic law right: that free-standing European rights have, in the absence of limitations created under Articles 100 to 102 and 235 of the Treaty,
Of, with specific reference to European law rights, by the Member States themselves, no time limits or, presumably other procedural limitations. To the extent that this latter point was developed in argument I understood it to have been modified to the extent that in the absence of specific legislative limitations, time and other procedural bars were for the creation Judiciary. Mr Goudie QC conceded however that because of the judgement of the Employment Appeal Tribunal in Scotland in RANKIN -v- BRlTISH COAL CORPORATION [1995] ICR 774 and in England in RASTALL -v- MEB (unreported 30th August 1995) he could not pursue his third alternative before me. Had he done so I should have unhesitatingly rejected it as being utterly inimical to the fundamental principles of legal certainty and social cohesion which underpin the Treaty. Although, in a slightly different context, Mr Goudie rightly warned me against the dangers of deceiving myself that I see anomalies in European law because I am looking through the eyes of a Common lawyer, I cannot believe that any legal system could contemplate what would be akin to the return of the legal Dark Ages prior to Lord Mansfield L.C.

There is no Salvation Except through Faith in the Qur'an
Allah says: O Muhammad, say,
[يَـأَهْلَ الْكِتَـبِ لَسْتُمْ عَلَى شَىْءٍ]
(O People of the Scripture! You have nothing...) meaning no real religion until you adhere to and implement the Tawrah and the Injil. That is, until you believe in all the Books that you have that Allah revealed to the Prophets. These Books command following Muhammad and believing in his prophecy, all the while adhering to his Law. Before, we explained Allah's statement,
[وَلَيَزِيدَنَّ كَثِيراً مِّنْهُم مَّآ أُنزِلَ إِلَيْكَ مِن رَّبِّكَ طُغْيَـناً وَكُفْراً]
(Verily, the revelation that has come to you from your Lord makes many of them increase in rebellion and disbelief.)
[فَلاَ تَأْسَ عَلَى الْقَوْمِ الْكَـفِرِينَ]
(So do not grieve for the people who disbelieve), Do not be sad or taken aback by their disbelief. Allah said next,
[إِنَّ الَّذِينَ ءَامَنُواْ]
(Surely, those who believe) referring to Muslims,
[وَالَّذِينَ هَادُواْ]
(those who are the Jews) who were entrusted with the Tawrah,
[وَالصَّـبِئُونَ]
(and the Sabians. ..) a sect from the Christians and Magians who did not follow any particular religion, as Mujahid stated. As for the Christians, they are known and were entrusted with the Injil. The meaning here is that if each of these groups believed in Allah and the Hereafter, which is the Day of Judgement and Reckoning, and performed good actions, which to be so, must conform to Muhammad's Law, after Muhammad was sent to all mankind and the Jinns. If any of these groups held these beliefs, then they shall have no fear of what will come or sadness regarding what they lost, nor will grief ever affect them. We discussed a similar Ayah before in Surat Al-Baqarah [2:62].
[لَقَدْ أَخَذْنَا مِيثَاقَ بَنِى إِسْرَءِيلَ وَأَرْسَلْنَآ إِلَيْهِمْ رُسُلاً كُلَّمَا جَآءَهُمْ رَسُولٌ بِمَا لاَ تَهْوَى أَنفُسُهُمْ فَرِيقاً كَذَّبُواْ وَفَرِيقاً يَقْتُلُونَ - وَحَسِبُواْ أَلاَّ تَكُونَ فِتْنَةٌ فَعَمُواْ وَصَمُّواْ ثُمَّ تَابَ اللَّهُ عَلَيْهِمْ ثُمَّ عَمُواْ وَصَمُّواْ كَثِيرٌ مِّنْهُمْ وَاللَّهُ بَصِيرٌ بِمَا يَعْمَلُونَ ]
(70. Verily, We took the covenant of the Children of Israel and sent Messengers to them. Whenever there came to them a Messenger with what they themselves desired not, a group of them they called liars, and others among them they killed.) (71. They thought there will be no Fitnah (trial or punishment), so they became blind and deaf; after that Allah turned to them (with forgiveness); yet again many of them became blind and deaf. And Allah is the All-Seer of what they do.) Allah reminds that He took the covenant and pledges from the Children of Israel to hear and obey Him and His Messenger. They broke these pledges and covenants and followed their lusts and desires instead of the law, and whichever part of the law they agreed with, they took it. Otherwise, they abandoned it, if it did not conform to their desires. This is why Allah said,
[كُلَّمَا جَآءَهُمْ رَسُولٌ بِمَا لاَ تَهْوَى أَنفُسُهُمْ فَرِيقاً كَذَّبُواْ وَفَرِيقاً يَقْتُلُونَوَحَسِبُواْ أَلاَّ تَكُونَ فِتْنَةٌ فَعَمُواْ وَصَمُّواْ]
(Whenever there came to them a Messenger with what they themselves desired not - a group of them they called liars, and others among them they killed. They thought there will be no Fitnah (trial or punishment) so they became blind and deaf.) thinking that they would suffer no repercussions for of the evil that they committed. Consequently, they were blinded from the truth and became deaf, incapable of hearing the truth. For these reasons they were unable to be guided by it. Allah forgave that, then,
[وَصَمُّواْ ثُمَّ]
(yet they became blind and deaf) again,
[كَثِيرٌ مِّنْهُمْ وَاللَّهُ بَصِيرٌ بِمَا يَعْمَلُونَ]
(many of them, and Allah is the All-Seer of what they do.) He has perfect knowledge of what they do and whomever among them deserves the guidance and whomever deserves misguidance.
[لَقَدْ كَفَرَ الَّذِينَ قَالُواْ إِنَّ اللَّهَ هُوَ الْمَسِيحُ ابْنُ مَرْيَمَ وَقَالَ الْمَسِيحُ يَابَنِى إِسْرَءِيلَ اعْبُدُواْ اللَّهَ رَبُّى وَرَبَّكُمْ إِنَّهُ مَن يُشْرِكْ بِاللَّهِ فَقَدْ حَرَّمَ اللَّهُ عَلَيهِ الْجَنَّةَ وَمَأْوَاهُ النَّارُ وَمَا لِلظَّـلِمِينَ مِنْ أَنصَارٍ - لَّقَدْ كَفَرَ الَّذِينَ قَالُواْ إِنَّ اللَّهَ ثَـلِثُ ثَلَـثَةٍ وَمَا مِنْ إِلَـهٍ إِلاَّ إِلَـهٌ وَحِدٌ وَإِن لَّمْ يَنتَهُواْ عَمَّا يَقُولُونَ لَيَمَسَّنَّ الَّذِينَ كَفَرُواْ مِنْهُمْ عَذَابٌ أَلِيمٌ - أَفَلاَ يَتُوبُونَ إِلَى اللَّهِ وَيَسْتَغْفِرُونَهُ وَاللَّهُ غَفُورٌ رَّحِيمٌ - مَّا الْمَسِيحُ ابْنُ مَرْيَمَ إِلاَّ رَسُولٌ قَدْ خَلَتْ مِن قَبْلِهِ الرُّسُلُ وَأُمُّهُ صِدِّيقَةٌ كَانَا يَأْكُلاَنِ الطَّعَامَ انْظُرْ كَيْفَ نُبَيِّنُ لَهُمُ الاٌّيَـتِ ثُمَّ انْظُرْ أَنَّى يُؤْفَكُونَ ]
(72. Surely, they have disbelieved who say: "Allah is the Messiah [`Isa], son of Maryam.'' But the Messiah said: "O Children of Israel! worship Allah, my Lord and your Lord.'' Verily, whosoever sets up partners (in worship) with Allah, then Allah has forbidden Paradise for him, and the Fire will be his abode. And for the wrongdoers there are no helpers.) (73. Surely, they have disbelieved who say: "Allah is the third of three.'' And there is no god but One God (Allah). And if they cease not from what they say, verily, a painful torment will befall on the disbelievers among them.) (74. Will they not repent to Allah and ask His forgiveness For Allah is Oft-Forgiving, Most Merciful.) (75. The Messiah [`Isa], son of Maryam, was no more than a Messenger; many were the Messengers that passed away before him. His mother [Maryam] was a Siddiqah. They both used to eat food. Look how We make the Ayat clear to them; yet look how they are deluded away (from the truth).)

and belal isnt that just expensive? use gmail :up: (and if you dont like their interface, for whatever reason (i thinks its great :D) you can use pop3 and smtp...unlike m$ they help you with that ;))

and you can even have pop3 from other emails with the gmail interface :up:

Ahh the terrible twos :D My daughter is 20 months old now and is starting to show signs of asserting her independance and testing the boundaries of what she can and can't do!

Keep in mind, that for him at this age, it is innate in him to 'test the waters' so to speak, every child will do this some way or another. He is testing the boundaries to see what is and what is not permissible to do.

Have you ever watched a wildlife documentary? You see the lion cubs playing with the dad lion, jumping all over him, running into his face etc etc, and he will sit patiently, until it gets too much and then he may swat out a paw just to remind the cubs who's boss lol :p

Children are exactly the same. they are learning thorough this 'play' what their limits are, what is safe for them to do, they are learning crucial social skills in this safe envorinment with their parents and family (before they grow up and enter the big wide world :p )

Boys in particular seem to have bucketloads of energy, and it is crucial that they use up this energy as constant 'trapping' of this energy can led to other bigger problems like hyperactivity, attention disorders, bad sleeping habits, eatings habits and so on.
What my limited experience with my daughter has taught me is that children subconsciously LOVE routine, they will feel safer with a routine ie: knowing when food is coming, knowig when it is bedtime etc etc.

Most people have a bedtime routine with their kids, maybe a warm bath, read book and then settle into bed. But the rest of the childs day may be utter chaos, mealtimes always changing everyday, sometimes being allowed to eat breakfast in pyjamas and sometimes having to get dressed first. Having a cup of juice with one meal and not with another.

There are so many examples, but what is important here is that you should really try to be consistent in their routine. For example, my daughter has a special 'chair' she sits on to eat, and she only sits on it for eating, it is not used for anything else. So she kows that when its time for her to sit in her 'chair' that it is mealtime, and she will eat her food and then be allowed to go off and play.

She has the same routine evry morning without fail, wake up, brush teeth, wash face, change nappy, change clothes and then breakfast time. It gives her some sense of familiarity and also some sense of independance because she feels that because she 'knows' what she is meant to be doing next, she can do it herself, if that makes sense?

In fact a couple of times I have left her at my mums house and she has 'instructed' my mum when she woke up what she was meant to be doing lol! (Telling her she needs to brush teeth and then change clothes and then brekkie!)

Also, in regards to food, try to cut out of sugary food as much as possible. Its hard cos most kids have a sweet tooth, however keep the cupboard stocked with loads of snack alternatives; raisins go down a treat, oat biccies, breadstciks, grapes, sweet apple or pear and so on. This will mean that come mealtimes, your child will want to eat cos he is still slightly hungry and not full up on snacks and drinks. Oh yeah, and no juice or drinks between meals. Water between meals and juice is limited to the table.

Above all, include him in everything you do, give him responsibilities, kids feel so happy and grown up when mummy asks them to do something. If you are hanging out laundry, get him to pass you the items, see if he can name whos clothes each one is (my daughter loves this mashaallah), if you are washing up, let him stand next to you on a chair by the sink and splash the water a bit, give him a bowl and spoon to bang about. If you are cooking, give him a couple of ingredients in a pan and let him mix them about and 'pretend.'

Its also very important to 'play' WITH him when he is playing, so do a jigsaw together, praise him a lot when he does something calmly or completes a game. Get a couple of sheet of paper and you can both draw things together, let him choose what to draw and then you choose what to draw.

I know these things sound very simple but if your child feels included in your daily life he will be much calmer around you and not feel that he has to 'playup' to get your attention becase you are giving it to him already without him asking for it.

If you give him choices in regards to anything, be it what clothes to wear, what food to eat, whether to go to the park or someones house, try to keep your choices limited to 2 options. Too many options can be confusing for a child and they may play up because they don't know how to respond to it. The same applies to no opitions or an open ended question like 'where do you want to go now?' 'what do you want to eat?' 'which clothes do you want to wear?' -- way to confusing for their little brains, keep the choice to 2 and let him decide between them. He will feel happy and important you have asked him and will be more likely to cooperate with something he has chosen!

Anyhoo, I can go on for hours lol, so I shall stop here.

Noise annoyance is one of the most studied reactions to auditory events.
