Can someone please tell me, with a straight answer (and preferably a fatwa that answers this question in a straight forward way):
Are the Shi'a Muslims, or non-Muslims?
Many sites seem to be saying that they are not Muslims (except Zaydis who are in Yemen) but they keep saying it in a strange way and not forthwrightly.
So, whats the answer?

The problem is that there is no definitive answer. Some say Shia are kafir, some say they are Muslim, but deviated from the Sunnah. For instance, in the 1950s, Al-Azhar declared that Jafari Shiism was a legitimate madhab to be followed. However, in recent years, under the influence of salafis, they've distanced themselves from this view. So it all depends on which scholar you follow. Most Sunnis ulema consider Shia to be Muslim, most Salafi ulema do not.

Why is this fitnah? Is it wrong to ask if a large segment of people claiming to be Muslims are Muslim?!?

Bro,
we should worry about this ummah unity than worrying what labels we should put on other people. Kufars knows our weakness & exploit it to throw fitnah on us.

There are non Salafis who consider Shia kafir.
and I heard the mufti of saudi Arabia say when asked about shia that we can not say that shia are kafir just like that, u have to look at the beleifs of the individual.
also, always back ur claim with evidance.
and is there any other sunni who declared Ja'fari madhhab as legitimate?
in Ja'fari madhhab mut'ah is halal which is against the ijma' (agreement) of the ummah - which is that mut'ah is haram-, also they don't believe in wiping over the khuf (or socks) which is proved by hadith mutawatir, and is agreed upon by the whole ummah.

This question of yours is indeed one of the most important questions of modern times...are the shia ithna asharyah kuffar? I will answer this question by asking you the following questions:
If someone comes along and worships 13 Gods...is he still a Muslim?
If someone does shirk by interceding with dead people and to graves, is he a muslim?
If someone asks Hussain or Ali exactly the same way the pagans of quraish used to ask their idol lat and Uzzah,l then is he a muslim or mushrik?
If someone attacks the honour of prophet Muhammad (i.e. his wifes) then is he a Muslim?
If someone says Prophet Muhammad's friend is a homosexual (i.e. Umar) than is this not the ultimate disrespect to the Prophet?
If someone says those who compiled the quran were unreliable and disblievers, than is this not an attack on the authenticity of the Quran?
Forget muttah, or wiping over the socks...the issue is greater than that.
It is an issue between tawhid and shirk.
NOTE I WILL PROBABLY BE BANNED FROM THIS FORUM BY THOSE SHIA LOVING MODS...

But can we actually call them "Kuffar?" Since a lot of them have grown up Shia and have never been given the true message?

No it's not, the one by Imam Ibn Taymiyyah rahimahullah is called Aqeedatu Waasitiyyah.
This one is written by Imam Jafar Tahawi, it's a hanafi kitaab.
